The coronavirus has smashed the Australian economy, and while we are hopeful for the future in Australia’s proactive response, unfortunately, many businesses have been forced to retrench some TSS visa holders. There are many reasons including Australian jobs prioritised, no access to JobKeeper for migrants, many migrants have been the last in, so first out and some industries more affected than others.

Ideally, before a business decides to cease employment, they should consult with migration experts to assess if there are any alternative option (for example Leave Without Pay, reduced hours or in certain cases varying of duties). There are certain government sponsorship obligations that employers need to adhere to. However, more than this, sponsoring employers have a moral obligation to assist their employees particularly migrant workers who are more at risk as they do not have the social welfare safety net of Australian workers, may not have Medicare and higher costs to repatriate etc.
